Terms and Conditions

1. Introduction

These terms and conditions govern your use of the websites and services provided by San Damiano Corporation Limited and its subsidiaries, including SD Care Agency, SD Care Agency (London), and Omnia Lifestyle Limited (collectively referred to as “the Group”, “we”, “us”, or “our”). By accessing our websites or engaging our services, you agree to these terms in full.

2. Service Provision

2.1 Care Services: All care services provided by SD Care Agency and SD Care Agency (London) are subject to an initial assessment of needs. We reserve the right to refuse service if we determine that we cannot safely or appropriately meet the requirements of the service user.

2.2 Clinical Treatments: Services provided by Omnia Lifestyle Limited are therapeutic in nature. Clients must disclose all relevant medical history before treatment begins.

2.3 Staffing: We endeavour to provide continuity of care; however, we reserve the right to substitute staff members to ensure uninterrupted service delivery.

3. Fees and Payments

3.1 Rates: Service rates are communicated during the assessment or booking process. We reserve the right to review and increase rates annually, providing at least 30 days’ notice.

3.2 Invoicing: Invoices are issued weekly/monthly and are payable within 14 days of the invoice date unless otherwise agreed in writing.

3.3 Late Payments: We reserve the right to charge interest on overdue accounts at a rate of 4% above the Bank of England base rate.

4. Cancellations and Terminations

4.1 Ad-hoc Cancellations: For individual care visits or clinical appointments, a minimum of 24 hours’ notice is required. Cancellations made with less notice may be charged at the full rate.

4.2 Termination of Contract: Either party may terminate a long-term care agreement by providing 14 days’ written notice, except in cases of immediate safety concerns or gross breach of contract.

5. Professional Conduct and Safeguarding

5.1 Zero Tolerance: We operate a zero-tolerance policy toward abuse, discrimination, or violence directed at our staff. We reserve the right to withdraw services immediately if our employees are placed at risk.

5.2 Safeguarding: In accordance with UK law, our staff are mandated to report any safeguarding concerns regarding vulnerable adults to the relevant Local Authority.

6. Limitation of Liability

6.1 While we strive for the highest standards of care, we are not liable for any indirect or consequential loss arising from the use of our services, except where such liability cannot be excluded by English Law (e.g., death or personal injury caused by our negligence).

6.2 We are not responsible for the loss of or damage to personal property within a service user’s home unless directly caused by the negligence of our staff.

7. Use of Website and Intellectual Property

7.1 All content on our websites, including text, logos, and images, is the property of San Damiano Corporation Limited.

7.2 You may not reproduce or redistribute any content from our sites without express written permission.

8. Data Protection

Your use of our services is also governed by our Privacy Policy, which explains how we handle your personal and sensitive health data in compliance with UK GDPR and the Data (Use and Access) Act 2025.

9. Amendments

We may update these terms from time to time to reflect changes in regulation or business practice. The latest version will always be available on our website. Continued use of our services after changes are posted constitutes acceptance of the new terms.

10. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
